How to Deal with Unsolicited Text Messages

Telemarketing solicitations have plagued American consumers for years, but the widespread popularity of smartphones has brought these marketers to a whole new medium: text messaging.

Last September, we talked about the Telephone Consumer Protection Act, which protects consumers from unsolicited phone interactions. The Telephone Consumer Protection Act, 47 U.S.C. § 227 (“TCPA”) is a federal statute that was enacted in 1991 to address concerns relating to telephone solicitations. While that blog post primarily dealt with phone calls, additions to the TCPA covers text messages, as well.

Is There Any Way to Stop Spam Texts?

Companies require your consent, oral or written, to send you solicitations. When you receive an unsolicited text message, don’t click on any links that might seem questionable.

Do not reply to these messages. Even sending the word “STOP” tells the spammer that your number is an active phone line. With that knowledge, a spammer will sell your information to other companies, increasing future calls or texts. Legitimate companies won’t send you a text request for personal information. So, if you can’t respond, how should you deal with them?

How to Report Spam Text Messages

Text message spam is illegal and you can, and should, report the spammer to your phone’s service provider. If you’re with AT&T, T-Mobile, Verizon, or Sprint, you can report spam text messages directly to the carrier by forwarding the original message to the number 7726 for free. If this fails to stop the communications, you can file a complaint with the FTC or the FCC at their respective websites.

How to Block Unwanted Messages

The National Do Not Call Registry is a resource managed by the FTC that you can use to avoid unwanted solicitations. A majority of legitimate companies won’t call or text you if your number is listed on the registry.
If you’re not sure whether your number is listed, there’s an option to verify whether it’s on the list or not.
